Quins s\u00f3n els <strong>factors de risc en els <a href=\"https:\/\/treball.gencat.cat\/ca\/ambits\/seguretat_i_salut_laboral\/riscos_i_condicions_treball\/mesures_per_risc\/viaria\/\" target=\"_blank\" rel=\"noopener\">despla\u00e7aments en l&#8217;entorn laboral<\/a><\/strong>?<br \/>\n<\/span><\/p>\n<div class=\"pd-15x link-dotted\" data-crawling=\"principal-body\">\n<p>Els treballadors estan exposats a <strong>factors de risc de patir accidents de tr\u00e0nsit<\/strong> i aix\u00f2 requereix l\u2019atenci\u00f3 i acci\u00f3 preventiva tant a les empreses\/institucions com dels mateixos treballadors.<\/p>\n<\/div>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #e6dfcc;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<h4><strong>Tipus d\u2019accidents laborals<\/strong>:<\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"li\"><span style=\"text-decoration: underline;\"><strong>Accidents in mission\/ &#8220;en jornada&#8221;<\/strong><\/span>: s\u00f3n els que tenen lloc fora del centre de treball per\u00f2 realitzant una tasca encomanda per l\u2019empresa (l\u2019escola, l\u2019institut, el departament, etc.) o de cam\u00ed al lloc on l\u2019hem de realitzar. Com per exemple, quan acompanyen els alumnes al teatre, al cinema, a una excursi\u00f3, quan anem a una reuni\u00f3 de feina, etc.<br \/>\nAquests <strong>despla\u00e7aments han de ser motivats<\/strong> per una ra\u00f3 vinculada al compliment de l\u2019activitat laboral, de les ordres o instruccions de l\u2019empresa o entitat per dur a terme la seva feina. En aquest cas l&#8217;empresa\/entitat ha de justificar la necessitat del despla\u00e7ament.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Accidents in it\u00ednere<\/strong><\/span>: s\u00f3n els que tenen lloc en el despla\u00e7ament habitual que fem per anar o tornar de la feina. Poden tenir lloc caminant, en transport p\u00fablic o en transport privat, per\u00f2 ha de ser durant un interval de temps determinat abans o despr\u00e9s de l\u2019horari laboral (\u00e9s a dir, si una persona viu a 20 minuts de la feina no pot tenir un accident in it\u00ednere una hora despr\u00e9s de sortir del centre\u2026).<\/p>\n<p>Tal com estableix l&#8217;article 156.2 a) de la <strong><a class=\"urlextern\" title=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11724\" href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11724\" target=\"_blank\" rel=\"nofollow noopener\">Llei general de la Seguretat Social<\/a><\/strong> i la jurisprud\u00e8ncia sobre els accidents de treball <em>in itinere<\/em>, cal que es donin quatre<strong> requisits per ser considerats com a tals<\/strong>:<\/p>\n<ol>\n<li class=\"level1\">\n<div class=\"li\"><span style=\"text-decoration: underline;\"><strong>Teleol\u00f2gic<\/strong><\/span>: la finalitat del despla\u00e7ament ha de ser la d&#8217;anar o tornar de la feina.<\/div>\n<\/li>\n<li class=\"level1\">\n<div class=\"li\"><span style=\"text-decoration: underline;\"><strong>Topogr\u00e0fic<\/strong><\/span>: el cam\u00ed utilitzat per al despla\u00e7ament ha de ser l&#8217;habitual i normal.<\/div>\n<\/li>\n<li class=\"level1\">\n<div class=\"li\"><span style=\"text-decoration: underline;\"><strong>Mec\u00e0nic<\/strong><\/span>: el mitj\u00e0 de transport emprat per salvar la dist\u00e0ncia a rec\u00f3rrer ha de ser l&#8217;habitual i adequat.<\/div>\n<\/li>\n<li class=\"level1\">\n<div class=\"li\"><span style=\"text-decoration: underline;\"><strong>Cronol\u00f2gic<\/strong><\/span>: el temps utilitzat ha de ser el normal, sense interrupcions per motius particulars que puguin trencar la relaci\u00f3 de causalitat, tenint en compte la dist\u00e0ncia a rec\u00f3rrer, el mitj\u00e0 de transport utilitzat, etc.<\/div>\n<\/li>\n<\/ol>\n<div class=\"pd-15x link-dotted\" data-crawling=\"principal-body\">\n<table style=\"width: 100%; border-collapse: collapse; background-color: #e6cccc; height: 80px;\">\n<tbody>\n<tr style=\"height: 80px;\">\n<td style=\"width: 100%; height: 80px;\">&nbsp;<\/p>\n<p><strong>L\u2019horari oficial declarat pels docents \u00e9s un document clau a l\u2019hora de determinar si un accident de tr\u00e0nsit es considera accident laboral o no. Aquest horari estableix les hores i llocs on el docent ha d\u2019estar treballant oficialment, i \u00e9s el punt de refer\u00e8ncia per valorar la cobertura en cas d\u2019accident.<\/strong><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #e6dfcc;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">\n<h4>Docents itinerants<\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"\" data-start=\"0\" data-end=\"264\">Els <a href=\"https:\/\/serveiseducatius.xtec.cat\/altcamp\/recursos\/recomanem\/itinerancies-i-desplacaments-dels-docents\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\"><strong data-start=\"4\" data-end=\"26\">docents itinerants<\/strong><\/span><\/a> s\u00f3n aquells que han de despla\u00e7ar-se entre diferents centres educatius o altres ubicacions per exercir la seva tasca docent. Aquests professionals tenen <strong data-start=\"1735\" data-end=\"1755\">drets espec\u00edfics<\/strong> en mat\u00e8ria de prevenci\u00f3 de riscos laborals, indemnitzacions per despla\u00e7aments i cobertura en cas d\u2019accident laboral \u2018in itinere\u2019. Es consideren itinerants els seg\u00fcents professionals:<\/p>\n<h5 data-start=\"266\" data-end=\"331\"><strong data-start=\"270\" data-end=\"331\">1. Mestres i professors amb destinaci\u00f3 en m\u00e9s d&#8217;un centre<\/strong><\/h5>\n<ul data-start=\"335\" data-end=\"593\">\n<li class=\"\" data-start=\"335\" data-end=\"481\">\n<p class=\"\" data-start=\"337\" data-end=\"481\">Mestres d&#8217;educaci\u00f3 prim\u00e0ria o professors de secund\u00e0ria que imparteixen classes en diversos centres educatius dins d\u2019una mateixa jornada laboral. (Per exemple, especialistes de m\u00fasica, educaci\u00f3 f\u00edsica o lleng\u00fces estrangeres assignats a m\u00e9s d\u2019una escola).<\/p>\n<\/li>\n<\/ul>\n<h5 data-start=\"595\" data-end=\"636\"><strong data-start=\"599\" data-end=\"636\">2. Alguns docents dels serveis educatius<\/strong><\/h5>\n<ul data-start=\"640\" data-end=\"1037\">\n<li class=\"\" data-start=\"640\" data-end=\"787\">\n<p class=\"\" data-start=\"642\" data-end=\"787\"><strong data-start=\"642\" data-end=\"704\">Equips d\u2019Assessorament i Orientaci\u00f3 Psicopedag\u00f2gica (EAPs)<\/strong>: psicopedagogs i mestres d\u2019educaci\u00f3 especial que donen suport a diferents centres.<\/p>\n<\/li>\n<li class=\"\" data-start=\"791\" data-end=\"909\">\n<p class=\"\" data-start=\"915\" data-end=\"1037\"><strong data-start=\"915\" data-end=\"960\">Equips d\u2019Assessorament en Llengua i Interculturalitat (ELICs)<\/strong><\/p>\n<\/li>\n<li class=\"\" data-start=\"791\" data-end=\"909\">\n<p class=\"\" data-start=\"915\" data-end=\"1037\"><strong data-start=\"915\" data-end=\"960\">Docents del CREDA<\/strong><\/p>\n<\/li>\n<\/ul>\n<h5 data-start=\"1039\" data-end=\"1122\"><strong data-start=\"1043\" data-end=\"1122\">3. Professors de Formaci\u00f3 Professional amb ensenyaments en diferents espais<\/strong><\/h5>\n<ul data-start=\"1126\" data-end=\"1320\">\n<li class=\"\" data-start=\"1126\" data-end=\"1219\">\n<p class=\"\" data-start=\"1128\" data-end=\"1219\">Docents que realitzen part de la seva activitat en empreses o centres de formaci\u00f3 pr\u00e0ctica.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1223\" data-end=\"1320\">\n<p class=\"\" data-start=\"1225\" data-end=\"1320\">Professors de modalitats d\u2019FP Dual que han de despla\u00e7ar-se a diverses entitats col\u00b7laboradores.<\/p>\n<\/li>\n<\/ul>\n<h5 data-start=\"1322\" data-end=\"1384\"><strong data-start=\"1326\" data-end=\"1384\">4. Docents que fan atenci\u00f3 domicili\u00e0ria o hospital\u00e0ria<\/strong><\/h5>\n<ul data-start=\"1388\" data-end=\"1516\">\n<li class=\"\" data-start=\"1388\" data-end=\"1516\">\n<p class=\"\" data-start=\"1390\" data-end=\"1516\">Mestres i professors que donen suport educatiu a alumnes que, per motius de salut, no poden assistir presencialment al centre.<\/p>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #f5ece1;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">&nbsp;<\/p>\n<h4><strong>Quan un docent hagi de realitzar una sortida del centre educatiu que no consti al seu horari oficial per motius de feina, aquesta sortida ha d&#8217;estar autoritzada i documentada per garantir la cobertura en cas d\u2019accident.<\/strong><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/li>\n<\/ul>\n<h3 class=\"\" data-start=\"221\" data-end=\"298\"><strong data-start=\"225\" data-end=\"296\">Documentaci\u00f3 necess\u00e0ria per quedar cobert en cas d\u2019accident laboral<\/strong><\/h3>\n<ol data-start=\"300\" data-end=\"1226\">\n<li class=\"\" data-start=\"300\" data-end=\"670\">\n<p class=\"\" data-start=\"303\" data-end=\"354\"><strong data-start=\"303\" data-end=\"352\">Autoritzaci\u00f3 pr\u00e8via de la direcci\u00f3 del centre<\/strong><\/p>\n<p>&#8211; Qualsevol despla\u00e7ament fora del centre <strong data-start=\"399\" data-end=\"439\">ha de ser autoritzat per la direcci\u00f3<\/strong> <span style=\"color: #ff0000;\"><strong>per escrit<\/strong><\/span>.<\/li>\n<li class=\"\" data-start=\"671\" data-end=\"968\">\n<p class=\"\" data-start=\"674\" data-end=\"727\"><strong data-start=\"674\" data-end=\"725\">Ordre de despla\u00e7ament o justificaci\u00f3 del servei<\/strong><\/p>\n<p>&#8211; Si la sortida implica una activitat oficial (per exemple, una reuni\u00f3 de coordinaci\u00f3, una formaci\u00f3, una visita a un altre centre, etc.), cal que <strong data-start=\"877\" data-end=\"921\">l\u2019\u00f2rgan convocant emeti una justificaci\u00f3<\/strong> que acrediti la necessitat del despla\u00e7ament.<\/li>\n<\/ol>\n<h3 class=\"\" data-start=\"2038\" data-end=\"2113\"><strong data-start=\"2042\" data-end=\"2111\">Qu\u00e8 passa si un docent t\u00e9 un accident sense aquesta documentaci\u00f3?<\/strong><\/h3>\n<p class=\"\" data-start=\"2114\" data-end=\"2420\">Si un docent pateix un accident durant un despla\u00e7ament laboral <strong data-start=\"2177\" data-end=\"2235\">sense autoritzaci\u00f3 pr\u00e8via i documentaci\u00f3 justificativa<\/strong>, podria no ser reconegut com un accident laboral i passaria a ser considerat un accident <strong data-start=\"2325\" data-end=\"2355\">fora de l\u2019\u00e0mbit de treball<\/strong>, amb les conseq\u00fc\u00e8ncies legals i econ\u00f2miques que aix\u00f2 comporta.<\/p>\n<p class=\"\" data-start=\"2422\" data-end=\"2589\">Per tant, \u00e9s essencial que qualsevol sortida que no consti en l\u2019horari oficial dels diferents professionals <strong data-start=\"2499\" data-end=\"2588\">sigui aprovada i documentada correctament per garantir la cobertura en cas d\u2019accident<\/strong>.<\/p>\n<hr \/>\n<table style=\"width: 100%; border-collapse: collapse; background-color: #e3ddca;\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\">&nbsp;<\/p>\n<h3 class=\"\" data-start=\"218\" data-end=\"286\"><strong data-start=\"222\" data-end=\"284\">Accident laboral vs. accident no laboral<\/strong><\/h3>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p class=\"\" data-start=\"287\" data-end=\"510\">\ud83d\udccc <strong data-start=\"290\" data-end=\"310\">Accident laboral<\/strong>: \u00c9s aquell que es produeix <strong data-start=\"338\" data-end=\"417\">durant la jornada de treball o en el trajecte d\u2019anada o tornada de la feina<\/strong> (<em data-start=\"419\" data-end=\"440\">accident in itinere<\/em>). Tamb\u00e9 inclou accidents durant despla\u00e7aments laborals autoritzats.<\/p>\n<p class=\"\" data-start=\"512\" data-end=\"693\">\ud83d\udccc <strong data-start=\"515\" data-end=\"538\">Accident no laboral<\/strong>: \u00c9s qualsevol accident que es produeix <strong data-start=\"578\" data-end=\"635\">fora de l\u2019entorn laboral i sense relaci\u00f3 amb la feina<\/strong>, com ara un accident dom\u00e8stic o durant el temps lliure.<\/p>\n<h4 data-start=\"695\" data-end=\"741\"><strong data-start=\"699\" data-end=\"739\">Prestacions i cobertura econ\u00f2mica<\/strong><\/h4>\n<p class=\"\" data-start=\"742\" data-end=\"775\">\u2705 <strong data-start=\"744\" data-end=\"773\">Si l\u2019accident \u00e9s laboral:<\/strong><\/p>\n<ul data-start=\"776\" data-end=\"1097\">\n<li class=\"\" data-start=\"776\" data-end=\"869\">\n<p class=\"\" data-start=\"778\" data-end=\"869\"><strong data-start=\"778\" data-end=\"794\">Baixa m\u00e8dica<\/strong> amb el <strong data-start=\"802\" data-end=\"837\">100% del sou des del primer dia<\/strong>, segons la legislaci\u00f3 vigent.<\/p>\n<\/li>\n<li class=\"\" data-start=\"870\" data-end=\"993\">\n<p class=\"\" data-start=\"872\" data-end=\"993\"><strong data-start=\"872\" data-end=\"897\">Assist\u00e8ncia sanit\u00e0ria<\/strong> coberta per la m\u00fatua de treball o l\u2019INSS (Seguretat Social), sense costos per al treballador.<\/p>\n<\/li>\n<li class=\"\" data-start=\"994\" data-end=\"1097\">\n<p class=\"\" data-start=\"996\" data-end=\"1097\">Possible <strong data-start=\"1005\" data-end=\"1043\">indemnitzaci\u00f3 per danys i seq\u00fceles<\/strong> si hi ha responsabilitat de l\u2019empresa o de tercers.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1099\" data-end=\"1136\">\ud83d\udeab <strong data-start=\"1102\" data-end=\"1134\">Si l\u2019accident \u00e9s no laboral:<\/strong><\/p>\n<ul data-start=\"1137\" data-end=\"1620\">\n<li class=\"\" data-start=\"1137\" data-end=\"1423\">\n<p class=\"\" data-start=\"1139\" data-end=\"1196\"><strong data-start=\"1139\" data-end=\"1173\">Baixa per incapacitat temporal<\/strong> amb menys cobertura:<\/p>\n<ul data-start=\"1199\" data-end=\"1423\">\n<li class=\"\" data-start=\"1199\" data-end=\"1239\">\n<p class=\"\" data-start=\"1201\" data-end=\"1239\"><strong data-start=\"1201\" data-end=\"1220\">Del dia 1 al 3:<\/strong> No es cobra res.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1242\" data-end=\"1309\">\n<p class=\"\" data-start=\"1244\" data-end=\"1309\"><strong data-start=\"1244\" data-end=\"1264\">Del dia 4 al 20:<\/strong> Es cobra el <strong data-start=\"1277\" data-end=\"1306\">60% de la base reguladora<\/strong>.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1312\" data-end=\"1423\">\n<p class=\"\" data-start=\"1314\" data-end=\"1423\"><strong data-start=\"1314\" data-end=\"1338\">A partir del dia 21:<\/strong> Es cobra el <strong data-end=\"1620\">No hi ha dret a indemnitzaci\u00f3 per responsabilitat empresarial.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"1622\" data-end=\"1677\"><strong data-start=\"1626\" data-end=\"1675\">Protecci\u00f3 en cas de seq\u00fceles o incapacitat<\/strong><\/h4>\n<p class=\"\" data-start=\"1678\" data-end=\"1700\">\u2705 <strong data-start=\"1680\" data-end=\"1698\">Si \u00e9s laboral:<\/strong><\/p>\n<ul data-start=\"1977\" data-end=\"2129\">\n<li class=\"\" data-start=\"1977\" data-end=\"2059\">\n<p class=\"\" data-start=\"1979\" data-end=\"2059\">En cas d\u2019incapacitat permanent, la pensi\u00f3 \u00e9s menor que en un accident laboral.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2060\" data-end=\"2129\">\n<p class=\"\" data-start=\"2062\" data-end=\"2129\">No hi ha rec\u00e0rrec de prestacions per responsabilitat empresarial.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"2131\" data-end=\"2177\"><strong data-start=\"2135\" data-end=\"2175\">Responsabilitat i cobertura legal<\/strong><\/h4>\n<p class=\"\" data-start=\"2178\" data-end=\"2200\">\u2705 <strong data-start=\"2180\" data-end=\"2198\">Si \u00e9s laboral:<\/strong><\/p>\n<ul data-start=\"2201\" data-end=\"2471\">\n<li class=\"\" data-start=\"2201\" data-end=\"2344\">\n<p class=\"\" data-start=\"2203\" data-end=\"2344\">L\u2019accident pot ser investigat per Inspecci\u00f3 de Treball per determinar si el centre ha complert les mesures de prevenci\u00f3 de riscos laborals.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2345\" data-end=\"2471\">\n<p class=\"\" data-start=\"2347\" data-end=\"2471\">Si es demostra neglig\u00e8ncia de l\u2019administraci\u00f3 o de l\u2019empresa, es pot reclamar una indemnitzaci\u00f3 o rec\u00e0rrec de prestacions.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"2473\" data-end=\"2499\">\ud83d\udeab <strong data-start=\"2476\" data-end=\"2497\">Si no \u00e9s laboral:<\/strong><\/p>\n<ul data-start=\"2500\" data-end=\"2624\">\n<li class=\"\" data-start=\"2500\" data-end=\"2624\">\n<p class=\"\" data-start=\"2502\" data-end=\"2624\">No hi ha responsabilitat de l\u2019empresa ni del Departament d\u2019Educaci\u00f3, i qualsevol reclamaci\u00f3 s\u2019ha de fer per via privada.<\/p>\n<\/li>\n<\/ul>\n<p class=\"entry-title\"><a
